Martin Kessman of Nanuet, N.Y., has been eating at White Castle for over 50 years, and either White Castle has shrunk their booths, or the burgers are catching up to Martin. The 64-year-old, 290 pounds man is suing the fast-food chain under the Americans with Disabilities Act…because he can no longer fit in their booths.
His inability to fit into the “booth-style seating” was “extremely embarrassing … to have to experience in front of a restaurant full of customers,” according to his lawsuit. He also experienced physical pain trying to squeeze into a booth and slamming his knee under the table.
Kessman claims he’s been filing complaints about the seating situation since April 2009, and was not impressed with the response. The company thanks him and sent a list of White Castles across the nation so he could find one with comfortable seating.
White Castle is surprised by the lawsuit. Spokesman Jamie Richardson said Martin had plenty of options available to him. It’s a fast food place, not a sit down restaurant. He could have asked for a chair, which White Castle has for those who don’t want to sit in a booth, or taken his food to go!
Kessman hasn’t set foot in a White Castle since filing the case…he has his wife pick it up for him! Yes, he’s still ordering his usual – a Number 2, which includes 2 double cheeseburgers, medium fries, and a small drink.
